Terms of Service

Last updated

These terms apply to your use of borrowwell.com.au and to the information published on it. They do not replace the written agreements that govern any credit assistance we provide to you, which are set out in our Credit Guide and Credit Proposal.

Who we are

Borrow Well Pty Ltd operates as Australian Credit Representative 574425 under Australian Credit Licence 390261. We are based in Adelaide, South Australia, and work with clients across Australia.

General information only

Everything on this website is general information. It does not take your objectives, financial situation or needs into account and it is not financial, credit, legal or taxation advice. Before acting on anything you read here, consider whether it is appropriate for your circumstances and obtain independent professional advice where appropriate.

Nothing on this website is an offer of credit. Any loan product, interest rate, borrowing capacity or repayment figure referred to is indicative, is subject to lender assessment and credit approval, and may change without notice. Actual terms depend on your individual application and the lender’s assessment criteria.

Fees and commissions

Borrow Well charges a fee for service. Our fee structure, and any commission we may receive from a lender in connection with your loan, are disclosed in full in your Credit Guide and Credit Proposal before you engage us. If anything in those documents is unclear, ask us before you proceed.

Our obligations to you

Where we provide credit assistance, we are required to make reasonable inquiries into your requirements, objectives and financial situation, to verify that information, and to assess whether a credit contract is not unsuitable for you. We will not suggest, assist with or recommend a credit contract that we assess as unsuitable.

Accuracy of information you give us

You agree that the information you provide to us is true, complete and not misleading, and that you will tell us promptly if your circumstances change during an application. Lenders assess applications on the information supplied, and providing false or incomplete information can result in a declined application, a mark on your credit file, or an offence under the National Consumer Credit Protection Act 2009 (Cth).

Intellectual property

The content, design and code of this website belong to Borrow Well or its licensors. You may read, print and share it for your own personal, non-commercial use. You may not reproduce it commercially or present it as your own without our written permission.

Third party links

This website links to third-party sites, including our booking system and lender websites. We do not control those sites and are not responsible for their content, availability or privacy practices.

Liability

We take care to keep this website accurate and available, but we do not guarantee that it is free of errors or that it will be uninterrupted. To the extent permitted by law, and subject to any rights you have under the Australian Consumer Law that cannot be excluded, we are not liable for loss arising from your use of, or reliance on, this website.

Complaints

If something has gone wrong, tell us first at hello@borrowwell.com.au or on 0470 461 263 so we can put it right. If you are not satisfied with our response, you can take the matter to the Australian Financial Complaints Authority, which is free and independent.
